Traffic Stop Leads to DWI and Endangering the Welfare of a Child Arrest

 

On June 3rd 2010, the New Hartford Police Department arrested Joseph L. Kimball Jr., age 49, of Paris Hill, after the New Hartford Central Dispatch received a call at approximately 10:00pm on June 3rd stating that an intoxicated male was operating a pickup truck on St. Rt. 12 southbound from Utica with a 3 year old child in the vehicle.  The New Hartford Central Dispatch immediately sent out a “Be On the Look Out” broadcast to the Town Of New Hartford Police patrols on duty.

New Hartford Police initiated a traffic stop of said vehicle on St. Rt. 12 at the Town of Kirkland line after receiving the “Be On the Look Out” broadcast.  After speaking with Kimball, Officer Jarod T. Petrie, determined that Kimball had been drinking and that he had his 3-year-old grandson in the vehicle.  The child was not in a child safety seat, nor was he seat belted while the vehicle was in motion.  Kimball was also found to have an open container of beer inside the vehicle.  Kimball was placed through multiple field sobriety tests, which he failed, and was subsequently placed under arrest. 

Kimball was transported to the New Hartford Police station where he was administered a breath test that determined his blood alcohol level was 0.20%, which is almost three times higher than the legal limit of 0.08%.  Kimball was charged with the recently enacted Leandra’s Law, which is Aggravated Driving While Intoxicated with a child less than 15 years old in the vehicle.  Leandra’s Law is a class E felony.  Kimball was also charged with Driving While Intoxicated, Aggravated Driving While Intoxicated for having a blood alcohol content higher than 0.18%, and Endangering the Welfare of a Child, all misdemeanors.  Kimball also faces the traffic infractions of consumption of alcohol in a vehicle, having a back seat passenger less than 4 years old with no child restraint system, and inadequate exhaust.  Kimball was arraigned in the Town Of New Hartford Court and was remanded to the Oneida County Correctional Facility in lieu of $800.00 cash bail.
