Utica Man Faces Charges after Incident at Applebee's

 

On Friday January 1, at 9:40 pm New Hartford Police were called to Applebees on Commercial Drive  for a report of a man trying to sell marihuana at the bar.  The first arriving officer located the man described by employees standing outside of the Optima gas station next to Applebees.  Applebees employees reported that the man had entered the business and went to the bar.  After ordering a beer the man began openly attempting to sell marihuana to other patrons at the bar.  While attempting to sell the marihuana the man displayed baggies of marihuana to the customers at the bar.  Employees at Applebees told the man to leave then called the Police.  Employees then followed the man outside and directed arriving officers to him. 

Officer Michael Reilly located the man at Optima and found him to be carrying seven small baggies of marihuana, a jar of marihuana and a glass pipe containing marihuana residue.  Additionally the man was found to be in possession of books stolen from Barnes and Noble on Commercial Drive.

Police charged Benjamin W. Brown age 29 of 22 Barnes Avenue 2nd floor Utica with Attempted Criminal sale of marihuana in the 5th degree, Possession of stolen property in the 5th degree and Unlawful possession of marihuana.    Brown was arraigned in New Hartford Town Court and remanded to the Oneida County Jail in lieu of $400.00 Cash bail or $1,000.00 bail bond.
