Road Rage Incident Leads to Multiple Arrests

Ptl. Michael T. Kowalski states that on 01-08-10 at about 1:35 am he observed a blue Dodge Neon traveling eastbound on State Route 5. Ptl. Kowalski states that the operator of the vehicle, later identified as Dale F. Pfendler age 26 of Chadwicks, was driving erraticly behind another vehicle. Ptl. Kowalski stated he observed Pfendler quickly change lanes and then cut in front of the other vehicle. Ptl. Kowalski stated that Pfendler then struck a curb causing the vehicle to spin out of control, coming to rest in the center of Route 5. Pfendler was subsequently arrested for DWI and transported to NHPD station for processing.

While awaiting a tow truck, a passenger in Pfendler’s vehicle, Francis Hoyt age 26 of Utica, refused to exit the vehicle to allow tow personnel to remove same. After a brief struggle with Ptl. W.J. Freiberger, Hoyt was arrested and charged with Obstructing Governmental Administration and Resisting Arrest.  Pfendler was processed at NHPD station and a breath test showed that his blood alcohol content was three times the legal New York State limit of .08%. Pfendler was charged with Aggravated DWI, Reckless driving, following to closely and failing to maintain a lane. Pfendler was released with traffic tickets returnable at a later date to the New Hartford Town Court.  Hoyt was arraigned before Judge Vanslyke in New Hartford Town Court and remanded to the Oneida County jail in lieu of $2,000.00 bail.
