Whitesboro Man arrested for Possession of Cocaine at K-Mart on Commercial Dr.

On February 5th, 2010 The store manager at K-Mart located on Commercial Dr., in The Town of New Hartford was alerted by a sales associate that she had found a small plastic bag containing a white powder that appeared to be cocaine within the store near the customer service area. 

The manager then contacted The New Hartford Police Dept. who responded to the store. Upon arrival a Police Officer secured the suspected cocaine found at the customer service desk.  While interviewing the store manager and other employees it was learned that a male in his twenties was at the customer service area just prior to the substance being discovered by the sales associate. During the investigation into this incident the suspected cocaine was field tested by police at which time it was confirmed to actually be cocaine.  While investigating,  Police were able to identify the male at the customer service area as 27 year old Zachary  Marshall of Whitesboro, N.Y.  Police determined that while making a purchase within the store the cocaine fell from Marshall’s wallet and he didn’t realize that it had happened.  Marshall then walked  away and exited the store just before police arrived.

On February 11, 2010, The New Hartford Police Dept.  located Marshall and he was arrested and charged with one count of Criminal Possession of a Controlled Substance in The Seventh Degree, which is a Misdemeanor. Marshall was issued an appearance ticket and is scheduled to answer the charge in The Town of New Hartford Court in March.
