Utica Man faces Assault Charges

On August 19th, 2009, at about 10:40 PM, the New Hartford Police were called to Cavallos Restaurant at 40 Genesee Street in the Village of New Hartford for a fight in progress.  According to Patrolman J. M. Spinella, Salvatore F. Davi, age 46 of Utica followed a male that is known to him out of the Cigar Bar at Cavallo’s.  Once outside, Davi spit on the male and then proceeded to punch the male in the face causing injury.  Davi was located at the scene and taken into custody.

Davi was charged with a Misdemeanor count of Assault in the 3rd degree.  Davi was arraigned in New Hartford Village Court in front of Judge VanSlyke.  Davi was able to post bail and was released.  Davi is due back in Village of New Hartford Court on September 2, 2009.

The male was evaluated for facial injuries by Edwards Ambulance and refused medical treatment.
