On October 3rd, 2009 at approx. 11:00pm, the New Hartford Police Department responded to a report of an intoxicated man at the Friendly’s Restaurant located on Burrstone Road. Staff noticed this male acting in an intoxicated manner and called the police. Upon arrival police officers found Timothy J. Ellis, 29 of Whitestown, N.Y. outside of the establishment in an impaired condition. When asked for identification Ellis pulled out a hypodermic needle from his pocket. Ellis was arrested for illegally possessing this needle and upon searching Ellis further, a total of 12 more needles were found. In addition Ellis was found to be in possession of a quantity of prescription pills. A subsequent investigation into this incident revealed that the needles that Ellis was in possession of were stolen from St. Elizabeth’s Hospital. Lorazepam is a controlled substance under the New York State Public Health Law.
Ellis was ultimately charged with criminal possession of a hypodermic instrument, criminal possession of stolen property in the fifth degree, and criminal possession of a controlled substance in the seventh degree, all of which are misdemeanors. Ellis was also charged with possessing a controlled substance outside of its container.
Ellis was arraigned in The Town of New Hartford Court by Judge William Vanslyke. Vanslyke ordered Ellis to be held in The Oneida County Jail on Lieu of $2,000 cash bail or $2,000 bail bond, pending a future court appearance.
